Enforcement — Advertisement Unit

 

Permit and advertising material licences are one of the main sources of revenue for the Enforcement Division of Miri City Council.

The unit covers bunting permits, stretch banners, business name signboards, fence advertising, project signboards, large billboards and all other advertising materials under the jurisdiction of the Council — governed by the Local Authorities (Advertisements) By-Laws, 2012.

Application Process — Temporary Advertising Licence

Note: A temporary licence not exceeding 3 months may be issued for religious, educational, cultural, political, social or recreational events. Advertising materials must be removed within 2 working days after the licence expires.

Required Documents — Business Name Signboard Application

 
  • 1Site / location plan or photograph showing placement of the signboard / advertisement
  • 2Sketch plan showing full details of the advertisement (design, measurement, material, structural detail) — endorsed by a registered Professional Engineer or sign craft manager (chopped and signed)
  • 3Extract of land title / print-out of land title
  • 4Tenancy Agreement or Letter of Consent from proprietor / Sale and Purchase Agreement
  • 5Form 9 / Form 24 / Form 49, Companies Act 1965 / Trade Licence
  • 6Registered trade mark (for business name only) — registered with the Intellectual Property Corporation
  • 7Public Liability Insurance (not compulsory but advisable)

Key Terms & Conditions

 
  • Two-tier advertisements on lamp posts are strictly prohibited.
  • Advertisements must be securely fastened, hung with a clearance of at least 6 feet from ground level and maintained in good condition throughout the display period.
  • Tobacco product and liquor advertisements are not permitted; content must be non-offensive.
  • Applicant is liable to pay a compound not exceeding RM 5,000 for breach of licence conditions.
  • Renewal applications must be submitted 3 months before the expiry date of the licence.
  • All advertisement structures must be removed and cleared from site within 14 days from the date of licence expiry (business name signboards, wall signs, billboards, blinds, etc.).
  • Where a licence is revoked, the licensee must remove the advertisement within 14 days from the date of revocation.
  • Deposit paid under By-Law 6(3) shall be refunded after expiry or revocation of the licence and removal of the advertisement, subject to any expenses incurred by the Council.
