Action For Not Paying Assesment Rates


ACTIONS ON RATEPAYERS IF THEY DO NOT PAY ASSESSMENT RATES:

i. SECTION 73 LOCAL AUTHORITIES ORDINANCE 1996

Issuing the first reminder notice (1 Month) to pay the current assessment rates and arrears,
the second notice 15 days before the payment deadline
and the last notice before caveat action


ii. SECTION 74(1)(2) LOCAL AUTHORITIES ORDINANCE 1996

A LATE FINE of 1% per month will be imposed.


iii. SECTION 173(a) SARAWAK LAND CODE

CAVEAT ACTION for the purpose of withholding all forms of transactions on the holding if there is no action for payment of 3 consecutive assessment rates bills (3 years) and it is still outstanding regardless of the amount outstanding.


iv. SECTION 75 LOCAL AUTHORITIES ORDINANCE 1996

If you still do not make payment after 3 months of notice and caveat action has been imposed on your land, the council will issue a “LETTER OF DEMAND” to demand the arrears.


v. SECTION 76(1) (2), SECTION 77, SECTION 78, SECTION 79, SECTION 80 LOCAL AUTHORITIES ORDINANCE 1996

And if after 3 months you do not make payment, LEGAL ACTION through the court will be taken against you.
(Form of action: seizure of the premises and sale by auction. Surplus of sale will be handed over to the ratepayer. If the holding is rented, the rental will be paid to the Council until the debt is settled)
